Please read these Terms of Service ("Terms") carefully. They govern your access to and use of the BabyPostal website and mobile applications (collectively, the "Platform") and the services offered via the Platform by BabyPostal, Inc. ("BabyPostal," "we," "us," or "our"). These Terms also contain important information about your legal rights, remedies, and obligations. By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.
Our collection and use of personal information in connection with your access to and use of the Platform is described in our Privacy Policy. We may modify these Terms from time to time. If you continue to use the Platform after changes go into effect, you will be deemed to have accepted the updated Terms.
1. The Platform
BabyPostal is an integrated parenting platform (the "Operating System for Parents") that provides a suite of tools and services designed to support families from pregnancy through the toddler years. The Platform includes, but is not limited to: a peer-to-peer Marketplace for listing, renting, selling, or donating baby-related items; a Baby Tracker for logging feedings, sleep, diapers, and milestones; a Leap Guide offering AI-assisted developmental stage information; a Medical Corner providing general health information; a Mom Wellness journal and resource center; Lullaby Songs and Bedtime Stories for children; Baby Games with age-appropriate activities; Baby Albums for family photo storage; a Community forum for parent discussions; a Family Travel Planner; a Safety Info center for product recalls and safety guidance; and related features. BabyPostal does not own, control, manage, offer, deliver, or supply any items listed on the Marketplace. When you transact with another user, you are entering into a contract directly with that user, not BabyPostal.
2. Eligibility & Accounts
You must be at least the age of majority in your jurisdiction to create an account and use the Platform. The Platform is designed for use by adults (parents and caregivers); children should only interact with the Platform under direct adult supervision. To access certain features, you must create a BabyPostal account and provide accurate and complete information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Prohibited Conduct
You agree that you will not: complete or attempt to complete any Marketplace transactions outside the Platform; use the Platform for fraudulent, illegal, or discriminatory purposes; harass, bully, or abuse any other user, including in Community forums; circumvent our fees or policies; copy, scrape, or otherwise exploit content from the Platform; damage, steal, or fail to return rented items; upload or distribute harmful, defamatory, sexually explicit, or deceptive content; post content in Community forums that constitutes medical advice, promotes unsafe products, or endangers children; upload photos of children who are not your own or for whom you do not have legal guardianship or explicit parental consent; use AI features to generate content that is misleading, harmful, or inappropriate for children; attempt to reverse-engineer, decompile, or extract the source code of any part of the Platform. Violation of these rules may result in suspension or termination of your account.
4. Marketplace Transactions
Payments: All Marketplace payments must be processed through the Platform. Providers may not accept cash or off-platform payments. Fees: BabyPostal may charge service or convenience fees on transactions. These fees will be clearly disclosed before you confirm a transaction. Cancellations and Refunds: Cancellation and refund policies are outlined at checkout and may vary by item type (sale, rental, donation). Damage and Returns: You are responsible for returning rented items in their original condition (normal wear excluded). You may be charged repair or replacement fees for lost, stolen, or damaged items. Item Safety: Providers are solely responsible for ensuring that listed items comply with applicable safety standards. BabyPostal does not inspect, certify, or guarantee the safety of any item listed on the Marketplace.
5. Content & Reviews
Users may post reviews, ratings, photos, text, and other content across the Platform, including in the Community, Baby Albums, and Marketplace listings. By posting content, you grant BabyPostal a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content for Platform operations, marketing, and improvement purposes. You retain ownership of your content and may delete it at any time, subject to technical limitations. Reviews and Community posts reflect individual opinions and do not represent BabyPostal's views. We reserve the right to remove content that violates these Terms or our Community Guidelines.
6. AI Features & Automated Content
Several features on the Platform use artificial intelligence, including but not limited to: the Leap Guide (developmental stage information), Medical Corner (general health information), Bedtime Stories (story generation), and contextual recommendations throughout the Platform. AI-generated content is provided for informational and entertainment purposes only. It is not a substitute for professional medical, psychological, developmental, or legal advice. AI outputs may contain errors, inaccuracies, or outdated information. You should independently verify any AI-generated information before acting on it, particularly regarding child health, safety, or development. BabyPostal does not guarantee the accuracy, completeness, or appropriateness of any AI-generated content.
7. Medical & Wellness Disclaimer
Content provided on the Platform, including in the Medical Corner, Mom Wellness, Leap Guide, Safety Info, and any AI-assisted responses, is for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. The Platform is not a healthcare provider. Always consult a qualified healthcare professional for medical concerns regarding yourself or your child. Never disregard professional medical advice or delay seeking treatment because of information accessed through the Platform. If you believe you or your child are experiencing a medical emergency, call your local emergency services immediately.
8. Baby Tracker & Health Data
The Baby Tracker allows you to log feeding schedules, sleep patterns, diaper changes, growth measurements, and milestones. This data is stored in your account for your personal use. BabyPostal does not use individual Baby Tracker data to provide medical recommendations. The Baby Tracker is a record-keeping tool, not a diagnostic or medical device. Patterns or insights surfaced by the tracker are informational only and should not replace guidance from your pediatrician or healthcare provider.
9. Children's Content & Safety
Certain features of the Platform, including Lullaby Songs, Bedtime Stories, and Baby Games, provide content designed for children. This content is intended to be used under adult supervision. BabyPostal does not knowingly collect personal information directly from children under 13 (or the applicable age in your jurisdiction). All accounts must be created and managed by adults. Parents and caregivers are responsible for supervising their children's interaction with any content on the Platform.
10. Photo Storage & Child Images
Baby Albums and other features allow you to upload, store, and organize photos, including photos of your children. By uploading photos, you represent that you have the legal right to share those images (e.g., you are the child's parent or legal guardian, or you have obtained explicit consent). Photos you upload are stored securely and are private to your account by default. Photos shared in Marketplace listings or Community posts become visible to other users according to the visibility settings you select. You may delete your photos at any time. BabyPostal does not use your photos for advertising or sell them to third parties.
11. Community Forums
The Community feature allows users to participate in discussions, ask questions, and share experiences. You agree to interact respectfully and in accordance with our Community Guidelines. You must not post content that: is abusive, threatening, or harassing; constitutes specific medical advice; promotes products or services unrelated to parenting; contains personal information of other users or their children without consent; is spam or commercial solicitation. BabyPostal moderates Community content but does not guarantee the accuracy or safety of user-posted advice. Rely on qualified professionals for important decisions about your child's health and well-being.
12. Family Travel Planner
The Family Travel Planner provides informational resources, itinerary suggestions, and links to third-party travel services. BabyPostal is not a travel agency and does not book travel on your behalf. Any transactions with third-party travel providers are governed by those providers' own terms and policies. BabyPostal is not responsible for the accuracy of travel information, availability of services, or any losses incurred through third-party travel bookings.
13. Safety Information & Product Recalls
The Safety Info feature aggregates publicly available product recall information and general child safety guidance. While we strive to keep this information current, BabyPostal is not an official safety authority and does not guarantee the completeness or timeliness of recall data. Always check official government sources (such as the CPSC in the United States or equivalent agencies in your country) for the most current recall information.
14. Audio & Story Content
Lullaby Songs and Bedtime Stories may include both original and AI-generated audio and text content. This content is licensed to you for personal, non-commercial use only. You may not redistribute, sell, or publicly perform any audio or story content from the Platform without prior written consent from BabyPostal.
15. Third-Party Links & Services
The Platform may contain links to third-party websites, services, or resources, including in the Family Travel Planner, Safety Info, and Marketplace. We are not responsible for the availability, accuracy, or content of such third-party resources or for their products or services. Your interactions with third-party services are governed by those services' own terms and privacy policies.
16. Ownership & Intellectual Property
The Platform, including all content, design, code, and features created by BabyPostal, is owned by or licensed to BabyPostal and protected by intellectual property laws. You are granted a limited, revocable, non-transferable license to use the Platform for personal, non-commercial use only. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.
17. Feedback
If you provide feedback, suggestions, or ideas to BabyPostal, you grant us the right to use them without restriction or compensation.
18. Disclaimers
The Platform and all content, features, and services are provided "as is" and "as available" without warranty of any kind, whether express or implied. BabyPostal makes no representations regarding the quality, safety, legality, or suitability of any items, content, or services available through the Platform.
19. Limitation of Liability
To the fullest extent permitted by law, BabyPostal's total liability for any claims related to the Platform, its content, or any items or services will not exceed the greater of (a) $100 or (b) the total amount you paid through the Platform in the 12 months prior to the claim. BabyPostal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, except where such limitation is prohibited by law.
20. Indemnification
You agree to indemnify and hold harmless BabyPostal, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: your use of the Platform or any items or services; your violation of these Terms or applicable laws; your interaction with other users; content you post or upload to the Platform; your negligent or wrongful conduct.
21. Dispute Resolution
Binding Arbitration and Class Action Waiver: Except where prohibited by law, you agree to resolve any disputes with BabyPostal through binding arbitration administered in Santa Clara County, California. You waive the right to participate in class actions, class arbitrations, or jury trials. This arbitration clause does not apply to claims for injunctive relief or claims related to intellectual property rights.
22. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
23. Termination
We may suspend or terminate your account or access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. You may request a copy of your data before account deletion, subject to our data retention policies as described in the Privacy Policy.
24. Credits & Virtual Currency
BabyPostal offers purchasable credit packs ("Credits") that can be used to access premium features across the Platform, including but not limited to generating Bedtime Stories, creating AI illustrations, generating meal plans in Mom Wellness, exporting Baby Albums, and creating AI lullabies. Credits are a limited, non-transferable, non-refundable digital license and are not real currency, property, or a stored-value product. Purchase: Credits are purchased in preset packs via one-time payments processed by Stripe, Inc. All prices are listed in US dollars and include applicable taxes where required by law. You will be redirected to Stripe's secure checkout page to complete your purchase. No Refunds: All credit purchases are final and non-refundable, except where required by applicable law (for example, EU consumer withdrawal rights within 14 days of purchase, provided no credits have been consumed). If you believe a charge was made in error, contact us at support@babypostal.com. Expiration: Credits do not expire as long as your account remains active. Upon account termination or deletion, any remaining credits are forfeited. Pricing Changes: We reserve the right to modify credit pack pricing at any time. Price changes do not affect credits already purchased. No Cash Value: Credits cannot be exchanged for cash, transferred to other users, or redeemed outside the Platform.
25. Payment Processing & Stripe
All monetary transactions on the Platform, including credit pack purchases and Marketplace checkout, are processed by Stripe, Inc. ("Stripe"). By making a purchase, you agree to Stripe's Terms of Service (https://stripe.com/legal) and Privacy Policy (https://stripe.com/privacy). For Marketplace Sellers: If you sell items on the Marketplace, payments are processed through Stripe Connect. You must complete Stripe's identity verification and onboarding process. Payouts are subject to Stripe's payout schedule and policies. BabyPostal does not store your full payment card details; all payment credentials are handled directly by Stripe's PCI-compliant infrastructure. Disputed Charges: If you dispute a charge with your bank or card issuer, we reserve the right to suspend your account pending resolution of the dispute.
26. Notifications & Communications
By creating an account, you consent to receive transactional communications from BabyPostal, including account verification, transaction confirmations, order updates, and security alerts. These communications are necessary for Platform operations and cannot be opted out of while your account is active. We may also send you optional communications, including feature announcements, tips, and promotional content. You may opt out of these non-essential communications at any time through your account settings or by using the unsubscribe link in any marketing email. We may send push notifications if you enable them in your browser or device settings. You can disable push notifications at any time through your device or browser settings.
27. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
28. Entire Agreement & Waiver
These Terms, together with the Privacy Policy and any additional terms you agree to when using specific features, constitute the entire agreement between you and BabyPostal regarding the Platform. The failure of BabyPostal to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of BabyPostal.
29. Assignment
You may not assign or transfer your rights or obligations under these Terms without BabyPostal's prior written consent. BabyPostal may assign its rights and obligations under these Terms without restriction.
